Terms of Service

1. Acceptance

By using Stymie (stymie.golf), you agree to these terms. If you do not agree, do not use the service.

2. The Service

Stymie provides a golf course directory, golf photographer directory, tee time alert notifications, golfer matchmaking, and course tracking. We do not guarantee tee time availability. Alerts are informational and booking is completed through third-party platforms or course websites.

3. Accounts

You are responsible for maintaining the security of your account. You must provide accurate profile information, particularly handicap and pace preference, as other users rely on this data for matchmaking.

4. User Conduct

Do not misrepresent your handicap or playing ability. Do not create fake profiles or listings. Do not use the platform to harass other users. Violations may result in account suspension.

5. Data Accuracy

Course data is sourced from third-party databases and may contain errors. Stymie does not guarantee the accuracy of scorecard data, ratings, or course details. Report inaccuracies to [email protected].

6. Photographer Directory Terms

The following terms apply specifically to photographers who create a profile on the Stymie Golf Photographer Directory.

6.1 Ownership of Content

You retain full ownership of all photographs, images, and creative work you submit to Stymie. Submitting content to Stymie does not transfer copyright or any other intellectual property rights. Your work remains yours.

6.2 Limited License to Display

By submitting photographs to Stymie, you grant Stymie a non-exclusive, royalty-free, revocable license to display your photographs solely for the following purposes:

  • Displaying your portfolio on your Stymie photographer profile page
  • Displaying your photographs on the course pages of golf courses you have tagged in your submissions
  • Including your work in the photographer directory listing and search results
  • Attributing your photographs with your name and a link to your Stymie profile wherever they are displayed on the platform

This license is limited to display on stymie.golf. Stymie will not sell, sublicense, distribute, or make your photographs available for download by third parties.

6.3 Attribution

Stymie will credit you by name on every photograph displayed on the platform. Where technically feasible, each photo will include a visible link to your photographer profile. You may specify how you want your name displayed when creating your profile.

6.4 Removal Rights

You may request removal of any or all of your photographs at any time by contacting [email protected]. Upon receiving your request, Stymie will remove the specified content within 5 business days. You may also request deletion of your entire photographer profile at any time.

6.5 No Obligation to Use

Submitting photographs does not guarantee they will be displayed. Stymie reserves the right to review and approve photographer profiles and to remove content that does not meet quality standards or violates these terms.

6.6 Representations and Warranties

By submitting photographs, you represent and warrant that:

  • You are the original creator of the photographs or have obtained all necessary rights and permissions to submit them
  • The photographs do not infringe on the copyright, trademark, privacy, publicity, or other rights of any third party
  • You have obtained any required model releases or property releases for identifiable individuals or private property depicted in the photographs
  • The photographs do not contain unlawful, defamatory, or obscene content

6.7 Indemnification

You agree to indemnify and hold Stymie harmless from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your breach of the representations in Section 6.6, including but not limited to copyright infringement claims related to photographs you submitted.

6.8 No Commercial Use by Stymie

Stymie will not use your photographs for advertising, promotional materials, merchandise, or any commercial purpose beyond displaying them on the platform as described in Section 6.2. If Stymie wishes to use your work for any purpose beyond platform display, Stymie will contact you separately and obtain your explicit written consent.

6.9 DMCA and Copyright Disputes

If you believe your copyrighted work has been used on Stymie without authorization, contact [email protected] with the following information: identification of the copyrighted work, the URL where the infringing material appears, your contact information, and a statement that you have a good faith belief the use is not authorized. Stymie will respond to valid takedown requests within 5 business days.

6.10 Profile Information

Information you provide in your photographer profile (name, bio, city, state, website, social media links, email, phone number) will be publicly visible on your profile page. You are responsible for the accuracy of this information and may update or remove it at any time by contacting [email protected].

7. Limitation of Liability

Stymie is provided as-is. We are not liable for missed tee times, inaccurate course data, interactions between users facilitated through Group Finder, or any disputes between photographers and third parties regarding intellectual property rights. Stymie is not responsible for unauthorized use of photographer content by third parties who may copy images from the platform despite our protective measures.

8. Modifications

Stymie reserves the right to modify these terms at any time. Material changes will be communicated via the email address associated with your account. Continued use of the platform after changes constitutes acceptance of the updated terms.

9. Governing Law

These terms are governed by the laws of the State of Florida. Any disputes arising under these terms shall be resolved in the courts of the State of Florida.
